Acceptable Use Policy
IT GLOBAL PTY LTD (ABN 26 160 457 205) and its affiliated companies, including INCLOODME PTY LIMITED (ABN 26 631 887 459) (we, us and our) is committed to providing a safe and secure environment and community for our members and other users of the products and services we provide (our Community Suite, as that term is defined in our Community Suite Terms of Use).
To help us achieve this goal, we have developed this acceptable use policy (Acceptable Use Policy) which reflects our values and expected standards of behaviour and sets out:
  • the activities that are not acceptable in relation to your use of our Community Suite and your interactions with other members of our Community Suite; and
     
  • the consequences for you if you engage in those activities.
     
You agree that your use of our Community Suite and your interactions with other members will be in compliance with the spirit and requirements of this Acceptable Use Policy. Throughout this Acceptable Use Policy, the word 'including' or similar terms or expressions do not limit what else is included unless there is express wording to the contrary.
 
  1. Professionalism, Social Responsibilities & Behaviours
     
    1. Our Community Suite provides members and other users with the opportunity to 'Inclood' themselves in a range of social and professional business environments. We are committed to maintaining a community that is socially accepting, respectful, professional and pragmatic.
       
    2. In accessing and using our Community Suite, and in interacting with other members, you must not (and must not permit any other person to):
       
      1. air personal grievances or disputes;
         
      2. intentionally harm or discredit others or their career or business prospects;
         
      3. disclose information without the appropriate consent or otherwise in a manner that would interfere with another person's reasonable expectations of privacy or confidentiality (such as the sharing of confidential or personal information without consent);
         
      4. act outside the scope of any authority granted to you by another member or contrary to any group policies that apply to you;
         
      5. behave in a manner that is dishonest, misleading, fraudulent or inappropriate (including by offering misleading or incomplete quotes, holding yourself out as having authority beyond your actual authority, procuring dishonest or fraudulent reviews or otherwise artificially improving or manipulating your profile);
         
      6. act in a way which is contrary to the spirit of any 'handshake' agreement made between you and another member;
         
      7. provide a false identity or inaccurate or incomplete information (including relating to licences, qualifications, work experience, affiliations, age, gender or achievements);
      8. create multiple accounts with the same details (including to disguise previous account history or to circumvent a previous account deactivation);
         
      9. seek to engage another to perform work at a significant undervalue or with low probability of compensation;
         
      10. seek or accept work or jobs for which you are not sufficiently skilled, experienced, qualified, licensed, accredited or otherwise capable of performing; or
         
      11. upload content that is not professional, relevant, and on-topic.
         
  2. Respecting others
     
    1. We strive to maintain a safe, inclusive, friendly, professional and respectful community for members of our Community Suite and other users. As such, we ask our members and other users to engage with others in a way that promotes a safe, inclusive, friendly, professional and respectful environment. We do not allow any behaviour which is offensive, unwelcome, unsolicited, unwanted or harmful.
       
    2. In particular, you must not (and must not permit any other person to):
       
      1. access, collect, copy or download (or attempt to access, collect, copy or download) any information, content or data relating to any other person which you are not authorised to access or for an unauthorised purpose;
         
      2. access, collect, copy or download (or attempt to access, collect, copy or download) any 'Community Library' content including community information, content or data in the library of documents (such as videos, images, podcasts, reference materials and checklists) without IT Global's authorisation or consent or for an unauthorised purpose;
         
      3. compromise the privacy or security of any other members information, including by sharing private passwords, content or other information;
         
      4. do anything which may infringe the intellectual property rights of another person without obtaining their consent or an appropriate licence from them;
         
      5. engage in harassment, abuse, bullying, stalking, discrimination, objectification, spamming or trolling;
         
      6. disseminate adult content or content which involves or encourages discrimination (including based on race, ethnicity, national origin, gender, sexual orientation, political or religious affiliations, or medical or physical condition), racism, bigotry, hatred, physical harm, nudity, drug use, crime or violence, or which is offensive, abusive, threatening, defamatory, libellous or hate speech;
         
      7. send unwelcome communications (including romantic advances, sexually explicit content, junk mail, spam, chain letters or phishing schemes); or
         
      8. otherwise engage in improper, offensive, cruel, insensitive, threatening, inflammatory, obscene, illegal, violent or infringing activities, including terrorism, grooming, child pornography and drug trafficking.
         
  3. Respecting us and our Community Suite
     
    1. Our members and other users in our community depend on the proper functioning and security of our Community Suite for their engagements and connections. In accessing and using our Community Suite, and in interacting with other members through our Community Suite, you must not (and must not permit any other person to):
       
      1. use our Community Suite in a manner that breaches, or is inconsistent with, the Community Suite Terms of Use;
         
      2. access (or attempt to access) any data, system, network, service or communication which you are not authorised to access;
         
      3. access (or attempt to access) our Community Suite on behalf of a third party without our consent (including by way of account sharing);
         
      4. access or collect (or attempt to access or collect) any information relating to any other person or our business methodologies or systems which you are not authorised to access;
         
      5. re-direct or divert (or attempt to re-direct or divert) any aspect of our business to another business (including by linking our members or other users to third party businesses, products or services);
         
      6. reverse look-up, trace (or attempt to trace) any information on any other member or user of our Community Suite to its source, or exploit our Community Suite or other members, or any service or information made available through our Community Suite or by other members, in any way for the purpose of revealing any information;
         
      7. use our Community Suite in a manner that creates, or may create, any liability (civil or criminal) for us or any of our third party service providers; or
         
      8. imply or state that you are affiliated with or endorsed by us when you are not.
         
  4. Specifically prohibited uses of our Community Suite
     
    1. You must not (and must not permit any other person to) use or access our Community Suite:
       
      1. to enter an arrangement for the purchase or provision of any illegal or unlawful goods or services in any jurisdiction, including embargoed goods, hazardous materials, illegal items, stolen property or unlicensed services;
         
      2. to engage in any form of illegal or unlicensed trading in any jurisdiction; or
         
      3. to request that another member perform a service without satisfying yourself that:
         
        1. all regulatory and other legal requirements necessary for the performance of that service have been complied with; and
           
        2. proper performance of that service will not cause that member to breach and regulatory or other legal requirements.
           
  5. Monitoring and consequences
     
    1. To maintain the integrity of our Community Suite, you acknowledge that we may (acting reasonably and for legitimate reasons):
       
      1. monitor and review any persons' interactions with our Community Suite, or our members or other users, and any of the information posted or otherwise made available on our Community Suite (including through the use of third party personnel and monitoring software and as a result of complaints or feedback from our members and other users);
         
      2. regulate and adjust any ratings in relation to members of our Community Suite; and
         
      3. remove any content or ratings from our Community Suite at any time.
         
    2. You also acknowledge that, if we reasonably believe that:
       
      1. your conduct in relation to our Community Suite is not in accordance with the spirit of this Acceptable Use Policy or is otherwise objectionable or offensive;
         
      2. your conduct in relation to our Community Suite amounts to an unlawful act and/or
        breaches this Acceptable Use Policy or the Community Suite Terms of Use; or

         
      3. you have permitted any other person to engage in conduct contemplated in paragraphs (a) or (b),
         
we may (acting reasonably and for legitimate reasons):
 
  1. alter the registration requirements for member accounts or terminate or suspend your access to all or part of a member account at any time without notice;
     
  2. terminate, suspend or restrict your access to, or use of, all or part of our Community Suite at any time without notice; and
     
  3. take any other actions we consider appropriate against you or another person (including involving relevant investigative bodies or authorities).
     
  4. In the event that we terminate, suspend or restrict your access to, or use of, all or part of our Community Suite, we will use our reasonable endeavours to notify you in advance of the termination, suspension or restriction.
     
  5. We may also take any other action contemplated in the Community Suite Terms of Use.
     
  1. Changes to this Acceptable Use Policy
     
    1. We may amend this Acceptable Use Policy from time to time at our discretion.
